Article 1: General provisions
The electronic web shop of Natural Mineral Cosmetics with registered office in 1980 Zemst, Laremolenweg 2 (Belgium), VAT 1013.977.028, (hereinafter NMC) offers its customers the opportunity to buy cosmetic products and raw materials for their production online.
These General Terms and Conditions (‘Terms and Conditions’) apply to every order placed by a visitor to this website (‘Customer’) with NMC .
Placing an order via the NMC webshop implies that the Customer has consulted these Terms and Conditions and expressly accepts their applicability, to the exclusion of all other terms and conditions. Additional terms and conditions of the customer are excluded, except when previously, in writing and explicitly accepted by NMC .
Items from the web-shop are paid for by the customer in advance. Upon receipt of payment, the order will be delivered to an address chosen by you in Europe. Because you have already bought the articles before you could view them, this is a remote sale. This means that you are entitled to 14 days’ right of withdrawal after delivery (see article 7). If an article does not meet your expectations, you can therefore cancel your order.
Article 2: Price
All prices stated are expressed in EURO, always including VAT and all other taxes to be borne by the customer. If delivery, reservation or administrative costs are charged, this will be stated separately.
The stated price refers exclusively to the articles as described verbatim.
Images are purely illustrative and decorative and may contain elements that are not included in the price or deviate from the article.
Article 3: Offers
Each offer is only open to customers residing in Europe. The articles are exclusively intended for normal private use. Companies must register with NMC for products for professional use.
Despite the fact that the website is compiled with the greatest possible care, it is possible that the information offered is incomplete, contains material errors or is not up-to-date.
For instance, it is possible that posted prices are outdated due to price adjustments by our suppliers. In such cases, NMC will contact the customer to communicate the new price.
The customer will then have the opportunity to cancel his order. NMC reserves the right not to deliver the products at the posted lower price.
Obvious mistakes or errors in the offer do not bind NMC. NMC is only bound by an obligation of means as to the correctness and completeness of the offered information. NMC is in no case liable in case of material errors, misprints or printing errors.
If you have specific questions about availability, delivery date or delivery method, please contact our customer service department in advance.
The offer is always valid while stocks last and can be adapted or withdrawn by NMC at any time. NMC cannot be held liable for the unavailability of a product.
We reserve the right to refuse orders in the following cases:
- In case of serious suspicion of abuse of law or bad faith on the part of the customer;
- Upon observation of an abnormal quantity of items ordered;
- Upon exhaustion of stock or the unavailability of an item
- In case of significant price increases of products compared to the prices listed in the web shop.
- If an invalid offer is established;
- In the event of force majeure.
Article 4 : Included in webshop
We cannot be held liable for any damage you may cause yourself as a result of decisions based on information from this site. If you are currently taking medicines, do not stop taking them or replace them without first consulting a doctor. Also during pregnancy, nursing or in the case of children under 2 years of age, it is wise to be well informed first.
Article 5: Online purchases
Non-professional customers can place and pay for their orders directly via the website. Professional customers are asked to register first. After obtaining a login, they can place their order. Registration is necessary for invoicing details. Foreign professional customers must also register. After verification of their foreign VAT number, they can buy VAT-free. An additional condition is that NMC sends the goods to the foreign customer. Goods cannot be collected from the shop.
The contract between the customer and NMC is concluded at the time of placing the order and paying the price by payment card.
NMC will send the goods, if in stock, to the customer within 2 working days. If the goods are not in stock, NMC will contact the customer for further arrangements on delivery.
The customer can choose between the following payment methods: Visa, Mastercard or Maestro.
NMC is entitled to refuse an order (in writing) due to a serious shortcoming by the customer regarding the order or any other order or agreement involving the customer.
Article 6: Delivery
NMC will send the goods, if in stock, to the customer within 2 working days. If the goods are not in stock, NMC will contact the customer for further arrangements on delivery.
Any visible damage and/or qualitative defect of an article or other shortcoming in the delivery must be reported immediately.
Article 7: Guarantee
a. Legal guarantee (for consumers only)
Under the Act of 21 September 2004 on the protection of consumers when selling consumer goods, consumers have legal rights. Each article is subject to the legal guarantee from the date of purchase by (if applicable, delivery to) the first owner. Any commercial warranty does not affect these rights.
b. General
To invoke the warranty, the customer must be able to produce the proof of purchase.
For articles purchased online and delivered to the customer’s home, the customer must contact customer service beforehand, after which the customer must return the article to NMC at his own expense.
Any defect must be reported by the customer within 3 working days of its discovery. After this, any right to repair or replacement expires.
The (commercial and/or legal) guarantee is never applicable as a result of accidents, neglect, falls, abnormal or incorrect use, use of the article contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, adjustments or changes to the article, heavy-handed use, poor maintenance, abnormal or incorrect use.
It also does not apply to articles with a shorter lifespan.
The warranty is not transferable.
Article 8: Right of withdrawal
You do pay for items from the webshop in advance. After payment has been received, these will be delivered to an address of your choice in Belgium or the Netherlands.
Because you have already bought the articles before you were able to view them, this is distance selling. This means you are entitled to 14 days’ right of withdrawal after delivery. If an article does not meet your expectations, you can thus cancel your order.
What is the right of withdrawal?
You have the right to notify us that you are abandoning your purchase and can return the package at your own expense within 14 calendar days of receipt. Contact our customer service department: info@naturalmineralosmetics.com.
Upon acceptance of your return, we will refund the purchase.
The period of 14 calendar days allows you to assess and inspect the purchased item as in a shop. During this time, you must handle the purchased item with due care. You may only unpack the item to the extent necessary to exercise your right of inspection. The purchased item may only be returned in its original condition and in its original packaging.
If the item is no longer saleable because you have used it, the item will be charged in full.
The right of withdrawal does not apply to the following articles either:
- used, soiled, damaged and incomplete articles
- items whose packaging has been opened (completely or partially) to such an extent that they can no longer be sold as new
Article 9: Privacy
The controller, NMC BV respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data.
The personal details you provide will only be used for the following purposes: executing the concluded agreement,
processing the order, sending newsletters, advertising and/or marketing purposes.
You have a legal right to inspect and possibly correct your personal data. Subject to proof of identity (copy of identity card), you can obtain a written, dated and signed request to NMC BV for free access to your personal details. If necessary, you can also ask to correct data that are incorrect, incomplete or irrelevant.
In case data are used for direct marketing: you can oppose the use of your data for direct marketing free of charge. To do so, you can always contact NMC BV.
We will treat your data as confidential information and will not pass them on, rent them out or sell them to third parties.
The customer is responsible for keeping his log-in data and password confidential. Your password is stored encrypted, NMC therefore has no access to your password.
NMC keeps online (anonymous) visitor statistics to see which pages of the internet site are visited to what extent. If you have any questions about this privacy statement, please contact us.
Article 10: Use of cookies
During a visit to the site, ‘cookies’ may be placed on your computer’s hard drive. A cookie is a text file placed by a website’s server in your computer’s browser or on your mobile device when you consult a website. Cookies cannot be used to identify individuals; a cookie can only identify a machine.
You can set your internet browser to not accept cookies, to warn you when a cookie is installed or to delete cookies from your hard disk afterwards. You can do this via your browser’s settings (via the help function). Please note that certain graphical elements may not appear correctly, or that you will not be able to use certain applications.

You accept that we shall not be liable for any damage, resulting from the use of our websites or the Internet, due to the aforementioned risks.
Article 11: Impairment of validity – non-impairment
If any provision of these Terms is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.
The failure at any time by NMC to enforce any of the rights enumerated in these Terms, or to exercise any right thereof, shall never be seen as a renunciation of such provision and shall never affect the validity of these rights.

Article 13: Modification of conditions
These Terms and Conditions are supplemented by other terms and conditions explicitly referred to and NMC’ general terms and conditions of sale. In case of contradiction, the present Terms and Conditions take precedence.
NMC may amend these Terms at any time without further notice. Any purchase after the amendment, implies an acceptance by the customer of these new Terms.
Article 14: Proof
The customer accepts that electronic communications and backups may serve as evidence.
Article 15: Complaints
Any visible damage and/or qualitative shortcoming of the articles or other shortcomings in the delivery must be reported immediately, on pain of forfeiting any right.
Article 16: Applicable law – Competent court
Belgian law is applicable, with the exception of the provisions of international private law on applicable law and with of the Rome I Regulation on international sales contracts on movable property. In the event of any disputes, the courts of Brussels shall have exclusive jurisdiction.
